NH House Rejects Lynch Education Amendment

"Democrats Say Republicans Didn't Give Proposal Proper Hearing"


Showing again the difficulty in finding compromise on school funding, the House on Wednesday rejected Gov. John Lynch's proposed constitutional change to give lawmakers more control over school aid and moved the fight to the Senate.

The House voted 264-114 against adopting Lynch's proposal and later killed it. Republican House Speaker William O'Brien scheduled the vote Wednesday rather than consider the proposal when the House reconvenes in January. A House-passed amendment awaits a vote in the Senate.

Democrats said that didn't give the public enough time to digest the idea and fought against voting on the proposal. They also called the vote a political stunt, since it was held the week after Thanksgiving.
"Amending our constitution is serious work, and I would have expected this amendment to go through the normal hearing process, with an opportunity for careful review and public input. Unfortunately, this was not the case," Lynch said after the vote.

He said he is willing to work with "anyone who shares the goal of passing an amendment that strengthens education in New Hampshire."

The House and Senate had each passed proposed amendments, but until Wednesday's House vote, each had postponed final votes on the other chamber's measure. In killing Lynch's amendment, the House also killed the Senate's proposal.

Both legislative proposals would give more control to lawmakers than Lynch proposed doing. The House amendment, authored by O'Brien, would give the state full discretion to decide how much, if anything, to pay for aid. The Senate will vote on it next year and could amend it to include Lynch's proposal, its proposal that the House killed or something new.

"The Senate continues to search for a solution to this long-standing problem concerning education funding. We hope the House remains committed to a compromise that will get enough votes to pass both houses and ultimately be approved by the voters in November," Senate President Peter Bragdon said in a statement.

House Republican Leader D.J. Bettencourt of Salem argued the vote was to get a sense of the where the House stood on the amendment so Republican House and Senate leaders could continue negotiating with the Democratic governor.

But state Rep. Gary Richardson, D-Hopkinton, didn't buy it and countered that the House action was "for purely political reasons."

Some supported Lynch's proposal as a good compromise. Others said Lynch's proposal would give the courts too much say.

State Rep. Gregory Sorg, R-Easton, said the amendment would do little to change things.
Lynch's amendment stated that the Legislature shall have the authority and responsibility to define reasonable school education standards, hold them accountable for meeting the standards and mitigate local disparities in their financial ability to provide an adequate education. It also would give lawmakers full discretion to determine aid amounts and its distribution.

The House and Senate passed different proposed amendments. Both legislative measures would give more control to lawmakers than Lynch proposed doing. The House amendment, authored by O'Brien, would give the state full discretion to decide how much, if anything to pay for aid.
Lynch's amendment was expected to fail, but the vote shows the difficulty lawmakers have had in changing the constitution since the state Supreme Court issued its landmark school funding rulings.
Republicans don't need Lynch to pass an amendment. They have a 294-104 margin over Democrats in the House, where they need 239 votes for passage, and a 19-5 edge in the Senate, where 15 votes are necessary. But O'Brien and Bragdon believe they need the popular Democrat's support to win voter approval at the ballot box.

If an amendment is placed on the ballot, two-thirds of voters would need to pass it for the change to take effect.

The state Supreme Court issued a landmark ruling in 1997 requiring New Hampshire to provide all public school children with an adequate education. After that ruling, the state began providing a base amount per pupil to all communities, funded by state taxes and a new state property tax.
New Hampshire lawmakers have tried and failed dozens of times over the years to nullify the ruling.
The Supreme Court's rulings require the state to pay the full cost of an adequate education, which means every community gets some aid. The rulings do not prohibit the state from sending additional aid to communities, but Lynch and other critics say the state has little extra money to spare after complying with the court mandate to pay for adequacy.

Lynch said his amendment would allow the state to target more aid while maintaining court review if the state fails to reasonably meet its responsibilities.

It occurred at 1:07 am and there are currently no reports of shaking.

True Hunting Story


A couple of weekends ago my wife and I were out for one of our sight-seeing drives and saw a sea of orange hats, vests, and fatigues marching into the woods for the opening weekend of deer season. The hunters were everywhere and looked mighty confident with all of the gear they were carrying.

Around the corner on one road, we looked over to our right in a farmers open field and broke into gut wrenching laughter. The twenty plus acre field was full of both deer and turkey's appearing to be having the time of there lives.

Turkey Leg's

A turkey farmer was always experimenting with breeding to perfect a better turkey. His family was fond of the leg portion for dinner and there were never enough legs for everyone. After many frustrating attempts, the farmer was relating the results of his efforts to his friends at the general store get together. "Well I finally did it! I bred a turkey that has 6 legs!"

Back to Basics

In years past, having worked retail, I was in the thick of things for black Friday, the day after thanksgiving. This year I'm going to be an observer and participant.  This year however it appears the retailers are very nervous and trying to be the first ones to open for black Friday. We even have some of them trying opening as early as 10:00pm on thanksgiving night to get to your dollar.  Walmart for example is requiring ALL of it's employee's to work four hour minimum shifts on Thanksgiving Day or sacrifice there holiday pay. What is wrong with that picture?

My true feelings are that we need to level this playing field and get back to basics. Start closing retailers on major holidays and stop them from opening on Sundays, let's get back to some family values, and get our economy back in balance. 

If businesses were required nationally to open certain hours during the week, they would have no problem, the competition would be the same and nobody would have to worry about getting the upper hand anymore over somebody else. Consumers would be able to make good choices and continue to go on with life.

Then again we have the free enterprise system here in the United States. You know what, enough of that, it is a crutch for business, people need some time off with family, and business needs to cool off and get back in line!  Big box retail needs to realize that the same amount of dollars are going to be spent no matter how many hours your open, people will reschedule their lives in order to accommodate business hours. Retail 101, your number one expense is payroll, and what better way to control your payroll and to increase your profits, by increasing the dollars per hour generated by fewer hours open.  Gee! That makes all the sense in the world to me!

And shame on us the consumer, we should know better. If we don't want business is to be open on Sunday we should stop shopping on Sunday. These businesses will get the message that people don't want it, and it would start closing on Sundays. Maybe we should start a national campaign to make this happen. Let's bring families back together and unite, let's bring life back to the basics.

Christmas 2011 -- Birth of a New Tradition -when are we going to take back control of our lives?

As the holidays approach, the giant Asian factories are kicking into high gear to provide Americans with monstrous piles of cheaply produced goods /merchandise that has been produced at the expense of American labor. This year will be different. This year Americans will give the gift of genuine concern for other Americans. There is no longer an excuse that, at gift giving time, nothing can be found that is produced by American hands. Yes there is!

It's time to think outside the box, people. Who says a gift needs to fit in a shirt box, wrapped in Chinese produced wrapping paper? Everyone -- yes EVERYONE gets their hair cut. How about gift certificates from your local American hair salon or barber? A manicure or pedicure?

Gym membership? It's appropriate for all ages who are thinking about some health improvement.

Who wouldn't appreciate getting their car detailed? Small, American owned detail shops and car washes would love to sell you a gift certificate or a book of gift certificates.

Are you one of those extravagant givers who think nothing of plunking down the Benjamins on a Chinese made flat-screen? Perhaps that grateful gift receiver would like his driveway sealed, or lawn mowed for the summer, or driveway plowed all winter, or games at the local golf course.

And of course there's the animal lover that can always use a gift card from the local pet store for food, supplies and even grooming in some stores.

There are a bazillion owner-run restaurants -- all offering gift certificates. And, if your intended isn't the fancy eatery sort, what about a half dozen breakfasts at the local breakfast joint. Remember, folks this isn't about big National chains -- this is about supporting your home town Americans with their financial lives on the line to keep their doors open.

How many people couldn't use an oil change for their car, truck or motorcycle, done at a shop run by the American working guy?

Thinking about a heartfelt gift for mom? Mom would LOVE the services of a local cleaning lady for a day.

My computer could use a tune-up, and I KNOW I can find some young guy who is struggling to get his repair business up and running.

OK, you were looking for something more personal. Local crafts people spin their own wool and knit them into scarves. They make jewelry, and pottery and beautiful wooden boxes.

Plan your holiday outings at local, owner operated restaurants and leave your server a nice tip. And, how about going out to see a play or ballet at your hometown theatre.

Musicians need love too, so find a venue showcasing local bands.

Honestly, people, do you REALLY need to buy another ten thousand Chinese lights for the house? When you buy a five dollar string of lights, about fifty cents stays in the community. If you have those kinds of bucks to burn, leave the mailman, the person who sells you stamps or mails your packages, the trash guy or babysitter a nice BIG tip.

You see, Christmas is no longer about draining American pockets so that China can build another glittering city. Christmas is now about caring about US, encouraging American small businesses to keep plugging away to follow their dreams. And, when we care about other Americans, we care about our communities, and the benefits come back to us in ways we couldn't imagine. THIS is the new American Christmas tradition.

Estate Sale

Decided to visit the Estate Sale this morning at 20 Shepard Ave to see what I may find. There wasn't too many things left in the home it was pretty well picked over. This surprised me only because they only had it open for two hours on Friday evening, and I was there ten minutes after they opened this morning. There were some 1/2 price clothing, a couple of twin beds that must have sold yesterday as they were marked NFS or not for sale. Items in the basement were 1/2 price but not much from which to choose. I did find a pair of field glasses that were marked $5.00 and were in the basement so $2.50(nice). We do a lot of hiking and walking and will be perfect for our purposes. Never know what you are going to find at an Estate sale until you visit them all.

So, I know I said just yesterday how winter in New England can be so hard and unforgiving.  Well, October this year treated us like winter, and November more like fall.  Today I have the unraken leaves and 60 degrees staring me in the face!  Do I rake, take a walk, or attack the estate sale around the corner?  The options are endless when the weather is nice.

Winter in New England

Living in New England has many adventures when it comes to it's weather.  Winter has the most weight placed on it due to it's many unique qualities.  There is the freezing rain which loves to test the stresses of human nature, tree's and electricity, commonly called "Ice Storms" up here.  It weigh's down branches to the point they cannot handle the stress and snap off causing them to land in roads and on power lines.  Then the power lines stress by arcing and shorting out and causing major power outages.  Then there is the human factor that try's the patience of those in it's path.  Power companies that are slow to respond, darkness, cold and the hum of generator's as people try to coexist with natures wrath.  Snow on the other hand uses it's white gloved hand to wipe away pollutants in the air and cover the fall leaves that we didn't get to before it graces us with her presence.  Be graceful winter and come in soft and leave with a whisper.  Thank you, New England!
